These Terms of Service (“Terms”) govern your access to and use of our website, store, and related services (the “Services”). By visiting or purchasing from the Site, you agree to these Terms and to our Privacy Policy, Shipping & Delivery Policy, and Returns/Refunds. If you do not agree, do not use the Services.

1. Eligibility & Accounts

  1. You must be at least 13 years old (or the age of digital consent in your jurisdiction). If you are 13–17, you must have a parent/guardian’s permission.
  2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

2. Orders, Pricing & Payment

  1. Order Acceptance. Your order is an offer to buy. We may accept or reject any order at our discretion (e.g., suspected fraud, pricing/availability errors).
  2. Pricing & Taxes. Prices, shipping rates, promotions, and taxes may change at any time. You are responsible for duties/taxes unless stated otherwise at checkout.
  3. Payment. We use third-party processors (e.g., Stripe/PayPal/WooCommerce gateways). By providing payment information, you authorize us and such processors to charge your method of payment for the total order. We do not store full card numbers on our servers.
  4. Typographical Errors. We may cancel or adjust orders that contain obvious pricing or description errors.

3. Custom/Personalized Items

  1. Production. Custom items are made-to-order. Production begins after we receive your content (e.g., photos) and, where applicable, after proof approval .
  2. Proofs & Approval. If we send a proof, you must review spelling, colors, composition, and size. Approval means you accept the result; later changes may incur fees or be unavailable.
  3. Color/Material Variance. Colors on screens can differ from final prints due to device calibration, materials, and inks. Minor variances are not defects.
  4. Non-Returnable. Unless defective or required by law, custom items are non-returnable and non-refundable . See Returns/Refunds.

4. Shipping, Delivery & Risk

  1. Delivery estimates shown at checkout or in our policy are estimates only.
  2. Title and risk pass to you when we hand the goods to the carrier. We will assist with carrier investigations for lost or damaged parcels per our Shipping & Delivery Policy.
  3. Split shipments may occur. Tracking numbers are provided when available.

5. User Content & Photo License

  1. Your Content. You may upload photos, text, reviews, and other materials (“*User Content*”). You represent and warrant that you own or have all necessary rights and that your User Content does not infringe any rights or violate laws.
  2. License to OracleFlame. You grant us a worldwide, royalty-free license to host, reproduce, adapt, and display your User Content solely to provide and promote the Services (e.g., design, production, order fulfillment, customer support, internal training).
  3. Marketing Showcase (Optional). We may display your final artwork (without full personal info) in galleries, ads, or social media. To opt out, email 85130181@qq.com with your order number.
  4. We may remove or refuse any User Content that we believe violates these Terms.

6. Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or harassing activities;
  • Upload malware or attempt to access non-public areas;
  • Infringe intellectual property or privacy rights;
  • Interfere with or burden our infrastructure, WordPress core, or plugins;
  • Circumvent security, rate limits, or payment flows.

7. WordPress, Plugins & Third-Party Services

  1. The Site is built on WordPress and may use WooCommerce and other themes/plugins, analytics (e.g., Google Analytics), ad pixels (e.g., Meta/Bing), payment gateways, email/SMS providers, and shipping APIs (“*Third-Party Services*”).
  2. Your use of Third-Party Services is subject to their terms and privacy policies. We are not responsible for outages, data loss, security incidents, or changes introduced by third-party updates (including WordPress core or plugin/theme updates).
  3. We may add, modify, or remove features, perform maintenance, or suspend access to part or all of the Services.

8. Promotions, Gift Cards & Subscriptions (if applicable)

  1. Promotions/coupons are subject to their rules and may be changed or withdrawn at any time.
  2. Gift cards are non-refundable and not redeemable for cash except where required by law.
  3. Subscriptions auto-renew at the then-current price unless you cancel before renewal.

9. Intellectual Property

  1. The Services and all content we create (artwork, templates, site design, text, graphics, logos) are owned by OracleFlame or our licensors and protected by law.
  2. Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Services.

10. Reviews & Feedback

If you submit ideas or feedback, you grant us a perpetual, worldwide, royalty-free license to use them without restriction or compensation.

11. SMS/Email Communications

By opting into our email or SMS programs, you agree to receive marketing and transactional messages. Message/data rates may apply. See SMS/MMS terms in the Privacy Policy for opt-out instructions (e.g., reply STOP to SMS).

12. Returns, Refunds & Warranty

See our Returns/Refunds and Shipping & Delivery. Except as required by law, the Services and products are provided “AS IS” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law:

  • OracleFlame and its officers, employees, affiliates, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption; and
  • Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim, or USD 100 , whichever is greater.

Some jurisdictions do not allow certain limitations—those limitations apply only to the extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless OracleFlame and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your misuse of the Services, or your violation of these Terms or applicable law.

15. Dispute Resolution; Governing Law

  1. These Terms are governed by the laws of England and Wales , without regard to conflict-of-laws rules.
  2. Venue. Courts located in Manchester, United Kingdom have exclusive jurisdiction, unless applicable consumer law provides otherwise.
  3. Arbitration (optional). Any dispute arising out of or relating to these Terms may be resolved by binding arbitration on an individual basis under the rules of London Court of International Arbitration (LCIA) in London, United Kingdom . Consumers in the EEA/UK retain any mandatory rights to bring claims in their home forum. Class actions are waived to the extent permitted by law.

16. DMCA/Copyright Notice (U.S. users)

If you believe content on the Site infringes your copyright, send a notice to our agent at 85130181@qq.com including: (a) your contact info, (b) the work claimed infringed, (c) the URL/location of the material, (d) a statement of good-faith belief, (e) a statement under penalty of perjury that your notice is accurate and you are authorized, and (f) your signature.
